These Terms of Service (“Terms”), together with our Privacy Notice, govern your use of our website(s), e-commerce site(s), and app(s) (individually and collectively, the “Site”). By visiting our Site and/or making a purchase through our Site, you agree to be bound by these Terms, and you represent that you are at least the legal purchase age for alcoholic beverages in your state, province, or jurisdiction. If you do not agree to these Terms, you may not access the Site or use any of our services. These Terms are subject to change.
1) Account Creation and Registration
In order to use some features of the Site (including, but not limited to, making online purchases), you may have to register for an account. This may include providing details such as your name, phone number, date of birth, address, and email address, and choosing a password. You agree not to create an account or use the Services if you have been previously banned from use of the Services.
2) Platform Provider; Shared Login
Our store’s Site is powered by Sante Technologies, Inc. Your data is stored with Sante Technologies, Inc. and may be used to log in to other Sante-powered retailers. If you have an active account with another Sante-powered retailer, you may be able to use the same login credentials.
3) SSO and Guest Checkout
You may use Social Sign-On (“SSO”) through Facebook or another social media platform to create and access your account. This involves sharing your social media account information with us.
We may offer, at our discretion, guest checkout. If you use guest checkout, you may be required to agree to the Google Pay, Apple Pay, or other applicable third-party terms of service.
4) Account Ownership and Security
You are responsible for maintaining the confidentiality and security of your account. You may not allow others to use your account. You are responsible for any unauthorized use of your account, and you must notify us through our ecommerce provider at [insert support email] if your account has been breached or used by anyone else.
You are fully responsible for all activities that occur under your password or account, and for any other actions taken in connection with the account or password. You agree to:
(a) immediately notify us of any known or suspected unauthorized use(s) of your password or account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password or payment information; and
(b) ensure that you exit from your account at the end of each session.
We will not be liable for any injury, loss, or damage of any kind arising from or relating to your failure to comply with (a) and (b) or for any acts or omissions by you or someone else using your account and/or password.
5) Age and Identity; Right to Refuse Service
By accessing the Site, you confirm that you are at least the legal purchase age for alcoholic beverages in your jurisdiction. You may be required to show proof of your age and identity at the point of purchase, order pick-up, or order delivery.
We reserve the right to cancel your order, refuse to fulfill an order, close your account, and/or refuse service to anyone for any reason at any time, including but not limited to suspected intoxication or suspected use of fraudulent identification.
6) Pricing and Availability
We reserve the right to change pricing at any time without notice. The prices on our Site may differ from the prices in our retail store(s).
We reserve the right (but are not obligated) to limit the sales of our products or services to any person, geographic region, or jurisdiction at any time, in our sole discretion. We reserve the right to limit the quantities of any products or services we offer. All descriptions of products and product pricing are subject to change at any time without notice, in our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on or through our Site is void where prohibited.
7) Ordering and Payments
You understand that your information (not including payment card information) may be transferred unencrypted. Please see the terms and conditions for third parties for their own data encryption practices.
8) Taxes
You are solely responsible for any and all duties, taxes, levies, or fees (including any sales, use, or withholding taxes) imposed by any authority on you by virtue of making a purchase through the Site.
9) Canceling and Changes to Orders
Please see our Return and Refund Policy for cancelation, return, and refund information. Any changes to online orders after an order has been placed are subject to our discretion and approval.
10) Shipping and Delivery
We may use third-party delivery services to deliver or ship your order, at our discretion and dependent upon availability. These delivery services may use independent contractors to fulfill delivery, and may have their own terms and conditions.
11) Limited License; Personal Use Only
You are granted, subject to these Terms, a personal, nonexclusive, non-transferable, limited license (without the right to sublicense) to access and use the Site for your personal, non-commercial use only. Our products are not intended for resale or wholesale distribution.
Collection or “scraping” of product listings, images, descriptions, pricing information, and/or other Site data, or any other data collection from our Site is prohibited and violates these Terms.
You may not modify, copy, distribute, re-publish, transmit, display, perform, reproduce, publish, reuse, resell, license, create derivative works from, transfer, or sell any information, content, material, software, products, or services obtained from the Site (whether manually or through use of any technological tool).
12) Site Administration; Intellectual Property
Our Site is powered by Sante Technologies, Inc. In all instances, all sales are advertised, accepted, made, and delivered by the licensed retailer.
The Site and its content, including the “look and feel” (e.g., text, graphics, images, and logos), proprietary content, information, and other materials, are protected under intellectual property, copyright, trademark, and other laws. You acknowledge and agree that Sante Technologies, Inc. and/or its licensors own all right, title, and interest in and to the services and their content (including all related intellectual property rights), and you agree not to take any action inconsistent with such ownership interests.
By using the Site, you do not acquire any rights or licenses under any of Sante Technologies, Inc.’s (or its licensors’) patents, patent applications, copyrights, trade secrets, trademarks, or other intellectual property rights on account of these Terms.
13) Reviews and Content You Share
You may be able to post reviews, photos, questions, comments, and other content, and/or submit suggestions, ideas, feedback, or other information. Content must not be illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, and must not contain software viruses or “spam,” and may not impersonate another person or entity.
We reserve the right to remove or edit content you post, but we are not obligated to review posted content. If you post content, you grant us an irrevocable, royalty-free, sublicensable right to use, reproduce, modify, publish, create derivative works from, distribute, and display such content (including the name you submitted in connection with the content, if applicable).
14) No Warranty; “As Is”
We make no representations or warranties, express or implied, regarding the Site and/or the accuracy, adequacy, reliability, availability, timeliness, completeness, accuracy, suitability, or other characteristics of information and materials contained on or presented on the Site. The Site and all related information and materials are provided “as is,” without any warranty of any kind, and on an “as available” basis.
We may change the Site at any time with or without notice, or close it indefinitely. Content on the Site (including product information) may be incorrect or out of date at any time, and we are under no obligation to update it.
15) Copyright
All content offered on our Site, including but not limited to images, videos, text, graphics, logos, button icons, audio clips, digital downloads, data compilations, and software is our property or the property of Sante Technologies, Inc. or of content suppliers, and is protected by United States and international copyright laws.
16) External Websites; Links to Third Parties
Our Site may contain links to independent third-party websites (including social media sites and articles). These links are provided as a convenience only. We are not responsible for the content of any third-party website or any link contained in a third-party website.
We do not review, approve, monitor, endorse, warrant, or make any representations with respect to any third-party website, and inclusion of a link does not imply affiliation, sponsorship, endorsement, approval, investigation, verification, or monitoring by us.
17) Limitations of Liability and Indemnity
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, LOSS OF GOODWILL, DAMAGE FROM ANY SECURITY BREACH OR ANY OTHER SECURITY INTRUSION, OR ANY OTHER PECUNIARY OR NON-MONETARY LOSS, HOWEVER CAUSED AND ON ANY LEGAL OR EQUITABLE THEORY OF LIABILITY, AND WHETHER OR NOT FOR BREACH OF CONTRACT, NEGLIGENCE OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

From time to time, we may offer promotions, coupons, credits, promo codes, event tickets, discount clubs, subscription services, and similar promotions or discounts. These promotions and programs are subject to cancellation and/or change without notice. Promotions, coupons, and offers may differ online and in store.
19) Gift Cards
At our discretion, we may offer gift cards. Gift cards are redeemable only for goods or services in-store and will not be replaced if lost or stolen. Gift cards may not be redeemed for cash and are not refundable.
20) Waiver and Severability
Failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
If any provision (or portion thereof) of these Terms is held by a court of competent jurisdiction to be invalid, illegal, void, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent, and the remaining provisions will continue in full force and effect.
